HRLC submits amicus curiae brief to European Court of Human Rights in Ukraine and the Netherlands v Russia

The HRLC has submitted a second amicus curiae brief to the European Court of Human Rights in cases that relate to Russian armed activities in Eastern Ukraine in 2014, the downing of the MH17 airliner over Ukrainian territory in July 2014, as well as more recent issues arising from the full-scale invasion of Ukraine from February 2022. The cases have been joined together by the European Court of Human Rights.

Drafted by Professor Sangeeta Shah (HRLC co-Director) and Professor Marko Milanovic (HRLC Fellow), the submission considers the various right to life and jurisdictional issues presented by the cases. The brief can be found here.

The HRLC was invited to file this second amicus brief by the Grand Chamber of the European Court following its initial intervention in the case at its preliminary admissibility stages. This first amicus brief can be found here and the Court’s admissibility decision can be found here.
