Commercial law and circular economy: friends or foes?

Reza Beheshti explains how commercial law impacts the circular economy.

Reza teaches and researches in the fields of international sales transactions, commercial conflict of laws, international commercial arbitration and comparative contract law. Most recently, his work has focused on how commercial law, in particular sale of goods, can promote the implementation of the circular economy, as an alternative to the classic linear economic model, which has led to the climate crisis and massive environmental damage.

Due to the absence of rules and regulations requiring manufacturers to produce goods compliant with a circular economy, the English Sale of Goods Act has limited capacity to hold manufacturers accountable in failing to manufacture compliant goods.
