On 25 April 2018, the Commission released the study in support of its evaluation of the database directive 96/9/EC.
Professor Derclaye is one of the experts, along with Professor Lionel Bently (University of Cambridge), who were in charge of the legal aspects of the study. The study was co-written and coordinated by JIIP and Technopolis. Its aim was to assess whether the directive on the legal protection of databases was still fit for purpose especially in the context of the data economy.
Her main tasks were to co-write the final report and the legal analysis. Along with Professor Bently and JIIP's and Technopolis' teams, she also conducted some interviews, helped moderating the workshop and devising the questionnaire and helped in the elaboration of country grids.
The elevation report of the European Commission based on the study has also been published today.
