Professor Derclaye was invited to talk to over 100 practitioners and academics at a webinar on the data act and its interaction with the database sui generis right at Hanken university school of law.
The webinar took place on 23 March and is part of a series on the new EU law ‘data laws’. The webinar retraced the history of the database sui generis right and commented on the relevant recitals of the data act and article 35 which maps the interaction with the database sui generis right. Professor Derclaye co-wrote a paper with Dr Husovec (LSE) on this issue in 2022 and also co-wrote the European copyright society’s opinion on the data act. The data act, an EU Regulation proposal which was adopted by the European parliament on 14 March 2023, aims to unlock the access and reuse of non-personal data in the EU and now entered the in the next phase before final adoption - it is being negotiated between the Parliament and the Council.
