Professor Irit Mevorach gives presentation at the ILA Academic Forum

On 29 March 2019, initially planned to be 'Brexit day', Professor Irit Mevorach gave a presentation on UNCITRAL New and Old Model Laws post-Brexit at the Insolvency Lawyers' Association (ILA) Academic Forum.

Mevorach critically examined the new UNCITRAL model law on recognition and enforcement of insolvency-related judgments (2018) against the backdrop of the older model law on cross-border insolvency (1997) and the additional work on a forthcoming model law on enterprise groups. Mevorach argued that the 2018 model suffers from certain shortcomings but that there are nonetheless ways to make the most of this new instrument. Generally the model laws framework has an increasingly important role especially in view of events such as Brexit.

Sonya Van de Graaff from Morrison Foerster (UK) LLP provided comments on the presentation and noted relevant jurisprudence on the issue of cross-border enforcement of insolvency-related judgments (29 March 2019, Allen and Overy LLP, London).
