Prof Estelle Derclaye with guest speaker Prof Lisa Ramsey
On 24 March, UNCLC were delighted to welcome Prof Lisa Ramsey who gave a fascinating talk on “Trademarks, Free Speech, and Inherently Valuable Expression”, based on her forthcoming book with CUP. Her presentation was filled with examples of recent cases such as the ‘Satan shoe’ v Nike case and Jack Daniels v. Bad Spaniels.
In her talk, Prof Ramsey gave examples of inherently valuable expressions she thinks should not be trademarked at all and the reasons why, pushing for legislatures and the international agreements such as TRIPs to adopt broader trade mark defences. A lot of undergraduate and postgraduate students, staff and external guests attended and posed interesting questions including on the use of trade mark in relation to new technologies such as NFTs.
